Excerpt: This article is a study of the law governing United States military procurement conducted outside the United States. Emphasis is placed on the recognition of the sources of law which apply to offshore contracts and the relationship between these rules and public and private international law. Specific topics discussed include the remedies available to resolve disputes arising out of offshore contracts, the effect offshore procurement has on the doctrine of sovereign immunity, and the problem of the proper choice of law to be applied in determining the contracting parties? respective rights and responsibilities.
